Terms and Conditions
Definitions
1.1 Vendor: Any individual or entity that submits a 3D model for optimization and manufacturing through the Website.
1.2 Customer: Any individual or entity that purchases a product listed on the Website.
1.3 Products: The 3D printed items manufactured and sold through the Website.
Service Overview
2.1 Bush Additive Manufacturing operates as a multi-vendor platform where Vendors submit 3D models for optimization.
2.2 The Website optimizes the submitted models and provides a quote for manufacturing costs.
2.3 Upon acceptance of the quote, Bush Additive Manufacturing will manufacture the product and take photographs for promotional purposes.
Vendor Responsibilities
3.1 Submission of Models: Vendors must ensure that their submitted models comply with all legal requirements, including but not limited to intellectual property rights.
3.2 Acceptance of Quotes: Vendors must review and accept the quote provided by Bush Additive Manufacturing before production begins.
3.3 Listing Products: Vendors are required to list their products on the Website at the minimum price quoted.
3.4 Profit Sharing: Profits from each sale will be split between Bush Additive Manufacturing and the Vendor, according to the agreed terms.
3.5 No Refunds: Once a Vendor has accepted a quote and production has begun, no refunds will be issued under any circumstances.
Prohibited Content
4.1 Vendors are strictly prohibited from submitting any 3D models that contain sexual, pornographic, obscene, violent, hateful, or otherwise prohibited content.
4.2 Any submission that violates this policy will be rejected without refund, and the Vendor’s account may be suspended or terminated at Bush Additive Manufacturing’s sole discretion.
Intellectual Property
5.1 Vendors retain ownership of their submitted 3D models but grant Bush Additive Manufacturing a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and promote the models for order fulfillment and marketing.
5.2 Vendors warrant and represent that their models do not infringe on any third-party intellectual property rights.
5.3 Vendors agree to indemnify and hold harmless Bush Additive Manufacturing from any claims, damages, or liabilities resulting from infringement or illegal use of submitted content.
Pricing and Payment
6.1 The pricing structure, including manufacturing costs and profit sharing, will be communicated to the Vendor prior to production.
6.2 All payments will be processed through the Website. Vendors will receive their share of profits according to the agreed profit split.
6.3 Withdrawal Rules:
- A minimum account balance of $5.00 is required before a withdrawal may be requested.
- Each withdrawal request is subject to a $1.00 withdrawal fee.
- Withdrawals are processed manually and may take up to 10 business days.
6.4 Vendors are responsible for ensuring their payment details are accurate. Bush Additive Manufacturing is not responsible for delays or losses caused by incorrect payment information.
User Accounts
7.1 Vendors must create an account to submit models and manage their listings.
7.2 Vendors are responsible for maintaining the confidentiality of their account information and all activities under their account.
Limitation of Liability
8.1 Bush Additive Manufacturing shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Website or Products.
8.2 Bush Additive Manufacturing does not guarantee the sale of any Products or the success of any Vendor’s listings.
8.3 Vendors use the Website at their own risk, and Products are provided “as is.”
Termination
9.1 Bush Additive Manufacturing reserves the right to suspend or terminate any Vendor’s account for violations of these Terms or for any conduct deemed harmful or inappropriate.
Dispute Resolution
10.1 Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation.
10.2 If unresolved, disputes shall be settled by binding arbitration in [Your Jurisdiction], and Vendors waive the right to participate in class-action lawsuits.
Governing Law
11.1 These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction].
Amendments
